1. Acceptance of Terms

By accessing or using drivercourseonline.com (the "Site") or enrolling in our course (the "Course"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Site or enroll in the Course.

These Terms constitute a legally binding agreement between you and Driver Course Online LLC ("Company," "we," "us," or "our"), a New York limited liability company.

2. Eligibility

To enroll in the Course you must:

  • Be at least 16 years old (or such minimum age as required by NY law for a driver's permit).
  • Be a New York State resident or prospective NY licensed driver.
  • Provide accurate and complete registration information, including your legal name and a valid phone number capable of receiving SMS.
  • Have a valid email address.

You may only enroll once per person. Creating multiple accounts to circumvent course requirements is prohibited and may be reported to the NYS DMV.

3. The Course

The Course is the New York State 5-hour pre-licensing course as approved by the NYS Department of Motor Vehicles under NY CRR 15 Part 10. Completion of the Course is one requirement toward obtaining a NY driver's license — it does not itself constitute a license or permit.

Seat time requirement: NY law requires a minimum of 270 minutes (4.5 hours) of active course engagement. Our system tracks time spent in each section. You cannot advance or submit for completion until the required time has elapsed. This is a legal requirement we cannot waive.

Identity verification: You will be required to verify your identity at multiple checkpoints during the Course via SMS one-time passcodes (OTP) and other verification methods. These requirements are mandated by the NYS DMV. Allowing another person to complete any portion of the Course on your behalf is a violation of these Terms and NY law.

Passing score: You must achieve a score of 70% or higher on each module quiz to advance. You may retake quizzes. Questions are randomized per attempt.

Completion certificate: Upon successful completion of all modules and identity verification requirements, we will issue your completion certificate and report your completion to the NYS DMV within 48 hours as required by law.

3.1 Course Terms & Conditions

By enrolling in this Course, you agree to the following terms as required by the NYS DMV:

  • Course completion requirements: You must complete all 10 modules and accumulate at least 270 minutes of active seat time. You must pass each module quiz with a score of 70% or higher.
  • Validation methods: Your identity will be verified through keystroke analysis, SMS one-time passcodes, personal security questions, and course content questions. These methods are designed to ensure you are the person completing the Course.
  • Content question requirement: You must successfully answer content questions throughout the Course to demonstrate engagement with the material. At certain checkpoints, you will be asked questions about the course content you just completed.
  • DMV notification: Upon successful completion, we will notify both the NYS DMV and you of your course completion. This notification is submitted electronically and typically takes 24-48 hours to appear on your driver record.
  • Road test scheduling: You may schedule your road test only after the DMV has received and posted your course completion to your driver record. This typically takes 24-48 hours after completion. Contact the DMV or your driving school for scheduling.
  • Privacy and fees: You agree to our Privacy Policy and acknowledge the schedule of fees disclosed at the point of sale. The total price shown at checkout is the full amount you will pay — there are no hidden fees.

4. Payment

The Course fee is displayed at checkout before you complete your purchase. All prices are in U.S. dollars and include applicable taxes.

Payment is processed securely by Braintree (a PayPal service), a PCI-DSS Level 1 certified payment processor. We do not store your full card number.

The NYS DMV charges a mandatory completion reporting fee of $8.00 per student. This fee is included in or added to your Course purchase price and is remitted to the DMV on your behalf. This fee is non-refundable once your completion has been reported to the DMV.

Your purchase is subject to our Refund Policy.

5. Refunds

Please review our Refund Policy before purchasing. Key terms:

  • Full refund available within 24 hours of purchase if you have not started any course module.
  • No refund once any module has been started.
  • The $8.00 DMV reporting fee is non-refundable once reported.

6. Acceptable Use

You agree not to:

  • Share your account credentials with any other person.
  • Allow or facilitate another person completing any portion of the Course on your behalf.
  • Use automated tools, scripts, or bots to interact with the Course.
  • Attempt to circumvent identity verification checkpoints, seat-time requirements, or any other DMV-mandated control.
  • Screenshot, record, reproduce, or distribute Course content without our written permission.
  • Use the Site for any unlawful purpose or in violation of any applicable law.

Violation of these terms may result in immediate account termination without refund and may be reported to the NYS DMV.

7. Intellectual Property

All Course content — including text, graphics, video, audio, quizzes, and the underlying software — is the property of Driver Course Online LLC or its licensors and is protected by copyright and other intellectual property laws. You are granted a limited, non-transferable, non-exclusive license to access and use the Course solely for your personal, non-commercial purpose of completing the NY pre-licensing requirement.

8. Disclaimer of Warranties

THE SITE AND COURSE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

We do not guarantee that completion of the Course will result in issuance of a NY driver's license or permit. Licensure decisions are made solely by the NYS DMV.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRIVER COURSE ONLINE LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR COURSE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE COURSE.

10. Indemnification

You agree to indemnify and hold harmless Driver Course Online LLC and its members, officers, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Site or Course, your violation of these Terms, or your violation of any applicable law.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Course shall be resolved exclusively in the state or federal courts located in Albany County, New York, and you consent to personal jurisdiction in those courts.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date. For material changes, we will notify you by email. Your continued use of the Site or Course after changes take effect constitutes acceptance of the revised Terms.
